1. Scope

EVE Audio GmbH [Ernst-Augustin-Str. 7, 12489 Berlin ,Germany] provides the EXO Firmware Updater as a free software tool for updating the firmware of selected EXO Series studio monitors.

2. Intended Use

‍

The firmware updater may only be used:

• with explicitly supported EXO Series models,
• in accordance with the provided instructions,
• in a technically suitable environment.

Any use with unsupported devices or under unsuitable conditions is at the user’s own risk.

3. Firmware Update Notice

‍

Firmware updates constitute a technical intervention in the device.
During the update process, it is essential that:

• the power supply of both the loudspeaker and the computer is not interrupted,
• the connection between the loudspeaker and the computer remains intact,
• the update process is not cancelled or terminated.

An interrupted or improperly performed update may result in malfunction or temporary or permanent inoperability of the device.

4. Limitation of Liability

‍

Use of the firmware updater is at the user’s own responsibility.

EVE Audio GmbH shall be liable without limitation:

• in cases of intent or gross negligence,
• for injury to life, body or health,
• in accordance with mandatory product liability laws.

In cases of slight negligence involving essential contractual obligations, liability shall be limited to foreseeable damages typical for this type of contract.

Any further liability, in particular for:

• indirect damages,
• loss of production,
• loss of profit,
• loss of data

is excluded to the extent permitted by law.

5. No warranty

‍

The firmware updater is provided “as is”.
There is no warranty that the software is error-free or continuously available.

EVE Audio GmbH reserves the right to modify, update or discontinue the firmware updater at any time.

6. License

‍

EVE Audio GmbH grants the user a non-exclusive, non-transferable right to use the firmware updater solely for its intended purpose.

Any further use, in particular:

• reproduction,
• distribution,
• rental,
• decompilation or reverse engineering

is prohibited to the extent permitted by law.

7. Governing Law

‍

This agreement shall be governed by the laws of the Federal Republic of Germany.
